Every person who has been prohibited by order of the Governor in Council from residing or being within this Colony for any space of time not exceeding five years under the provisions of Ordinance No 8 of 1882, and who without lawful authority or excuse, the proof of which shall lie upon him, is in this Colony after the date of such order, or after the time fixed for his departure and before the expiration of the term of his banishment, shall be guilty of a misdemeanour, and upon conviction thereof shall be liable to imprisonment, with or without hard labour, for a period not exceeding one year; and the Court or Magistrate in addition to the said punishment shall direct that the said person, if a male, shall for the first offence be once whipped and for the second or subsequent return from banishment be twice or thrice whipped.

Sec. 44 of Ordinance No 8 of 1882 are repealed, provided that such repeal shall not revive any enactment repealed by the said Ordinance 3 of 1881, and shall not affect the past operation of the said Ordinances or anything done or suffered thereunder.

When any person is convicted of a crime under Ordinance No 8 of 1865, and at the time of the commission thereof shall have been armed with any offensive weapon or instrument, or who at the time of or immediately before or immediately after the commission thereof, shall have wounded, beat, struck or used any other personal violence to any other person, or who shall together with one or more persons, have robbed or assaulted with intent to rob, or who shall by any means whatsoever attempt to choke, suffocate, or strangle any other person, or shall by any means calculated to choke
